Terms of Service

Agreement

These terms govern your use of Tiny Desk AI at gettinydeskai.org (the "Service"). By creating an account, buying credits or generating a video, you agree to them. If you do not agree, do not use the Service.

What the Service does

The Service takes one, two or five photos you provide and uses AI video models to recast performers in a short band clip modeled on the viral "Outstanding" Tiny Desk trend, so the people in your photos appear in it. Results are produced by AI and can vary; likeness, lip sync and timing are not guaranteed to be perfect.

Who can use it

You must be at least 18 years old and able to enter a binding agreement. You are responsible for your account and for everything done with it, so keep your login details safe.

Photos you upload

You may upload a photo only if:

• it shows you, or a person who has given you permission to use their photo for this purpose;
• everyone in it is 18 or older;
• it does not show a celebrity, politician or other public figure;
• you have the right to use it.

By uploading, you confirm these conditions and give us permission to process the photo only to generate your video.

The clip and its sound

Videos follow a fixed band clip modeled on a trend that started on TikTok. The "with sound" download carries the trend's original audio, which belongs to its rights holders; it is offered for personal, non-commercial posts, and you are responsible for how you share it. On platforms with a sound library, such as TikTok, post the silent download and add the sound there. Tiny Desk AI is an independent fan tool and is not affiliated with NPR, Tiny Desk Concerts, Charlie Wilson or The Gap Band.

What you may not do

Do not use the Service to:

• make videos of anyone without their consent, or impersonate anyone;
• create content meant to deceive, defame, harass, bully or intimidate;
• create sexual, violent or hateful content, or any content involving minors;
• present a generated video as real footage, or pass it off as a real recording or release by any artist;
• break the law or infringe anyone's rights;
• overload, scrape, reverse-engineer or work around the limits and safety filters of the Service.

When you post a video, label it as AI-generated where the platform asks you to. We may refuse, remove or block content and suspend accounts that break these rules. Accounts that repeatedly trigger the safety check are banned, and credits already used are not refunded.

Credits and payments

• Videos are paid for with credits. The credits each video uses depend on the model and resolution you choose and are shown on the button before you generate.
• Credits are currently sold through Stripe as one-time packs. Packs are charged once and never renew. Prices are shown in US dollars and may include applicable taxes.
• If subscription products become available again, their checkout page and the applicable terms will explain renewal, cancellation and credit validity before purchase.
• Pack credits do not expire. Credits have no cash value and cannot be transferred.
• If a render fails or times out, the credits for that render are returned to your balance automatically. If the video is made but our video provider's safety check then blocks it, the provider still bills the render, so those credits are used and the video is not delivered.
• Unused packs can be refunded within 7 days of purchase; email support@gettinydeskai.org. Packs that have been partly used are not refundable, except where the law requires otherwise.

Your videos

Subject to these terms and to the rights of others, you may download and share the videos you generate:

• for personal use, for example on your own social media accounts; and
• to promote your own business in organic (unpaid) posts on social media accounts that you own or manage for that business.

You may not:

• use generated videos in paid advertising or sponsored posts, including boosted or promoted posts;
• sell, license or otherwise distribute generated videos for a fee; or
• make videos for clients or for any business other than your own.

Copyright complaints

If you believe content on the Service infringes your rights, email support@gettinydeskai.org with the content in question, your contact details and a description of the rights involved. We will review the request promptly and remove material where appropriate.

Availability and changes

We may change, pause or discontinue the Service or individual models at any time. We will try to give notice of significant changes. If we discontinue the Service, we will refund unused credits.

Disclaimers

The Service is provided "as is" and "as available". To the extent the law allows, we make no warranties about the Service or its results, including that it will be uninterrupted, error-free or that a video will look exactly as you expect.

Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental or consequential damages, and our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim.

Ending your use

You can stop using the Service and ask us to delete your account at any time. We may suspend or close accounts that break these terms.

Changes to these terms

We may update these terms. The date above shows the latest version. If you keep using the Service after a change, the new terms apply.
